Welcome to the Superconscious community! These Shared Agreements (“Terms”) are here to create a clear and respectful understanding for your engagement with the Superconscious website, mobile applications, artificial intelligence features, and related services (collectively, the “Services”), offered by Superconscious.io (“we,” “us,” or “our”). By choosing to access or use our Services, you are joining us in agreement with these Terms, our approach to Privacy, and the important understandings outlined on our Disclaimers page. If these agreements do not resonate with you, we understand and respect your choice not to use our Services.

1. Our Services: A Space for Growth

Superconscious is a platform thoughtfully designed to support your personal growth and the exploration of consciousness. Our Services offer tools such as AI-powered “activations,” guided journaling opportunities, ways to observe your journey's progress and other features intended to enhance your path. These may include text-to-speech, voice analysis, and, as we evolve, potentially voice cloning and video capabilities. We offer these with the intention of providing a supportive and insightful environment.

2. Joining Our Community: Eligibility and Account Integrity

Age Considerations

To use our Services, we ask that you be at least 13 years of age. If you are between 13 and 18 (or the age of legal majority where you live), we invite you to use the Services with the guidance and agreement of a parent or legal guardian, who also agrees to these Terms. Our approach to engaging with younger users is further detailed in our Privacy Policy, in alignment with regulations like the Children's Online Privacy Protection Act (COPPA).

Creating Your Space

To access many features of our Services, creating an account helps us personalize your experience. We encourage you to provide information that is accurate and current, and to keep it updated, so we can best support your journey.

Maintaining a Secure Space

The password you create is for your keeping, and you are invited to be mindful of activities that occur through your account. Please let us know if you ever sense any unauthorized use. We encourage the use of strong passwords and offer multi-factor authentication (2FA) as an added layer of security for your peace of mind.

Shared Responsibility

We see engagement with your account as a shared responsibility. Activities under your account are best managed with your awareness and authorization.

3. Subscriptions and Payments: Supporting the Platform

Subscription Options

We may offer different ways to engage with our Services, including a model with some complimentary access, a “Pro” plan with upgraded features and usage. Details about current subscription options and their pricing will be clearly available within the Services or on our website.

Exploring with Trials or Limited Access

We may offer opportunities to experience certain features through free trials or limited access. The specifics of such offerings will be clear when presented. Sometimes, at the end of a trial, your access may transition to a paid subscription unless you choose to cancel beforehand.

Billing Process

When you choose a paid service and provide a payment method, you authorize us to process the subscription fees at the current rate, along with any other applicable charges. You are responsible for any applicable taxes.

Continuity of Service

To ensure uninterrupted service, your subscription may automatically renew for a similar period unless you choose to cancel it before the end of the current subscription period. This means your chosen payment method would be charged for the renewal term.

Your Choice to Cancel

You are always free to cancel your subscription at any time through your account settings or by contacting us. Cancellations will become effective at the end of your current billing period. For partial subscription periods, refunds or credits are generally not provided, as access remains available for the paid term.

Evolving Offerings

As our Services grow and evolve, we may adjust our subscription plans or pricing. We will always provide you with notice of any such changes that affect your plan.

External Payment Pathways

In line with app store policies, we might offer or guide you to external payment methods for subscriptions. If you use these, their terms will also apply.

4. Engaging with the Services: Mindful, Ethical, and Respectful Use

Our Shared Intention for a Positive Space: Superconscious.io is designed as a sanctuary for personal growth, conscious exploration, and the fostering of well-being. We invite you into this space with the shared intention that our collective engagement—yours, ours, and the community's—contributes positively to the individual and the whole.

Invitation to Use: We grant you a limited, non-exclusive, non-transferable, non-sublicensable opportunity to access and use the Services for your personal growth and exploration, in a non-commercial way, as long as your use aligns with these Terms.

To maintain a harmonious, beneficial, and ethically sound space for everyone, and to ensure our Services are used for good and not for harm, we ask that you agree to the following principles of conduct:

Unlawful, Unauthorized, or Unethical Activities

  • Using the Services for any purpose that is illegal under local, state, national, or international law.
  • Engaging in any activity that is fraudulent, misleading, or deceptive.
  • Accessing or attempting to access accounts, systems, or data that you are not authorized to access.

Infringement of Rights

  • Intellectual Property: Uploading, posting, or transmitting any content that infringes upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Privacy: Collecting, harvesting, or gathering personal information of other users without their explicit consent.
  • Publicity: Using any person's name, likeness, or identity without their permission for commercial or exploitative purposes.
  • Other Rights: Any action that violates the legal rights of others, including contractual or fiduciary rights.

Interference, Disruption, and Security Breaches

  • Interfering with or disrupting the integrity or performance of the Services or the data contained therein.
  • Attempting to gain unauthorized access to the Services, other accounts, computer systems, or networks connected to the Services, through password mining, hacking, or any other means.
  • Introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Engaging in any denial-of-service attacks or similar disruptive activities.
  • Using any automated means (bots, scrapers, spiders) to access or interact with the Services without our express written permission.

Harmful, Hateful, Abusive, or Disruptive Content and Conduct

  • Posting or transmitting content that is hateful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Engaging in bullying, intimidation, or stalking of other users.
  • Promoting or inciting violence, terrorism, or self-harm.
  • Sharing content that exploits or endangers minors.
  • Engaging in discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic.

Harm to Others

Using the Services in any manner that could harm, injure, or impair the well-being of any individual or group, whether directly or indirectly.

System Integrity and Reverse Engineering

Attempting to decompile, disassemble, reverse engineer, or otherwise attempt to discover the source code, underlying ideas, or algorithms of the Services, except to the extent that such restriction is expressly prohibited by applicable law.

Resource Abuse

Using the Services in a way that consumes an unreasonable or disproportionate amount of our infrastructure resources, or that could impair the experience of other users.

Ethical and Responsible AI Engagement

Our AI features are designed to empower and support. We ask that you engage with them responsibly and ethically:

Responsible and Ethical Input

  • Do not input content that is illegal, harmful, hateful, discriminatory, sexually explicit, or violent into any AI feature.
  • Do not attempt to manipulate AI systems to produce outputs that violate these Terms or any applicable law.
  • Do not use AI features to generate content intended to deceive, defraud, or mislead others.
  • Do not input personally identifiable information of others without their explicit consent.
  • Do not use AI features to create deepfakes or synthetic media intended to harm, defame, or impersonate others without consent.

Ethical Application of AI-Generated Outputs

  • Do not use AI-generated content to infringe on intellectual property rights.
  • Do not present AI-generated content as solely human-created in contexts where such distinction is legally or ethically important (e.g., academic submissions, professional advice, news reporting).
  • Do not use AI-generated content for unauthorized commercial purposes.
  • Do not use AI-generated content to spread misinformation, disinformation, or propaganda.
  • Do not use AI-generated content to harass, bully, threaten, or intimidate any person.
  • Do not use AI-generated voice clones or likenesses without the explicit consent of the individual whose voice or likeness is being replicated, except for your own personal, non-commercial use as intended by the Service.
  • Do not use AI-generated content in any way that could cause physical, psychological, or financial harm to any individual or group.
  • Do not use AI-generated content to create or distribute child sexual abuse material (CSAM) or any content that exploits minors.

Prohibition on Misuse

Any deliberate attempt to misuse AI features for purposes contrary to the spirit and letter of these Terms, including attempting to bypass safety filters or content moderation, is strictly prohibited.

Community Guidelines

As part of our community, we invite you to:

  • Embrace Respect and Empathy: Treat all members of the Superconscious community with dignity, kindness, and understanding. Foster a welcoming environment where diverse perspectives are valued.
  • Engage Mindfully and Responsibly: Use the Services with awareness and intention. Consider the impact of your words and actions on others within the community.
  • Uphold a Safe and Supportive Space: Help us maintain a space free from harassment, bullying, hate speech, and any form of abuse. Report any behavior that compromises the safety of the community.
  • Act with Integrity and Legality: Be honest in your interactions, respect the intellectual property of others, and ensure your use of the Services complies with all applicable laws and these Terms.
  • Protect Our Shared Platform: Refrain from any activity that could harm the technical infrastructure, security, or the experience of other users on the platform.
  • Adherence to Guidelines and Terms: Familiarize yourself with and follow these Community Guidelines and the full Terms of Service. Failure to do so may result in actions being taken on your account.

Failure to Adhere: We believe in the goodness of our community. However, if these principles are not upheld, we may, at our discretion and without prior notice, take actions including, but not limited to, issuing warnings, suspending or terminating your account, removing content, and/or reporting illegal activities to the appropriate authorities. We may also pursue legal remedies.

Reporting: If you encounter any content or behavior that you believe violates these Terms or our Community Guidelines, please let us know by contacting us. We take such reports seriously and will investigate them.

Content Moderation: We reserve the right, but are not obligated, to monitor, review, and moderate all User-Generated Content and interactions on our platform to ensure compliance with these Terms, Community Guidelines, and applicable laws. This may involve automated tools and human reviewers.

5. Your Contributions: User-Generated Content

Your Expressions

Our Services offer you spaces to create, upload, post, and share your insights and expressions, such as text inputs for AI, chat messages, journal entries, images, audio recordings, and other materials.

Responsibility for Your Contributions

You are the steward of your User-Generated Content and any consequences of sharing it. By sharing, you affirm that you have the rights or permissions to do so.

Allowing Us to Share and Improve

When you contribute User-Generated Content through our Services, you grant Superconscious a worldwide, non-exclusive, royalty-free, sublicensable, and transferable permission to use, reproduce, distribute, adapt, display, and perform this content. This is primarily so we can operate, develop, provide, improve, and promote the Services for you and the wider community.

AI Learning and Growth

As detailed in our Privacy Policy, certain User-Generated Content may help us train and refine our AI models, always with your awareness and choices as outlined.

Your Insights

If you offer feedback, suggestions, or ideas about the Services (“Feedback”), we appreciate these insights and may use them freely to enhance the Services for everyone, without obligation or compensation to you.

6. Honoring Creations: Intellectual Property

Our Platform's Integrity: The Services, including all associated intellectual property rights (such as software, algorithms, AI models, designs, text, graphics, logos, and trademarks), are and remain the property of Superconscious.io or our licensors. These Terms do not transfer any ownership rights to you. Unauthorized use of our intellectual property is a violation of these Terms and potentially applicable laws.

Our Marks: “Superconscious,” “Superconscious.io,” and related logos and names are trademarks of Superconscious.io. You may not use these marks without our prior written permission.

Your Ownership: You retain ownership of the original content you create and submit as User-Generated Content, subject to the license you grant us in Section 5.

7. Engaging with Artificial Intelligence Features

Our Services incorporate AI technologies to enhance your experience. When engaging with these features, please keep in mind:

  • AI as a Tool: AI features are designed to assist and support, not to replace professional advice (medical, legal, financial, psychological, or otherwise). Please refer to our Disclaimers page for more details.
  • Accuracy and Limitations: While we strive for quality, AI-generated content may not always be accurate, complete, or up-to-date. AI can sometimes produce unexpected or incorrect results (“hallucinations”). You should use your own judgment and verify any important information.
  • Your Inputs Matter: The quality of AI output is influenced by the input you provide. We encourage thoughtful and clear inputs for the best experience.
  • Evolving Technology: AI features may change, improve, or be updated over time as technology evolves. We will strive to keep you informed of significant changes.
  • Data Use: Your interactions with AI features may be used as described in our Privacy Policy, including for improving our AI models, subject to your choices and applicable law.

We encourage you to approach AI-generated content with an open but discerning mind, using it as one of many tools on your path of personal growth.

8. Our Commitment to Your Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, share, and protect your personal information when you use our Services. By using our Services, you acknowledge that you have read and understood our Privacy Policy, which forms part of these Terms.

9. Navigating External Links and Services

Our Services may contain links to third-party websites, services, or resources that are not owned or controlled by us. We do not endorse and are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such third-party content, goods, or services.

10. Understanding Our Service Offering

Our Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that:

  • The Services will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the use of the Services (including AI-generated content) will be accurate, reliable, or meet your expectations.
  • Any errors in the Services will be corrected.
  • The Services will be compatible with all devices or software.

11. Regarding Responsibility and Liability

To the maximum extent permitted by applicable law, in no event shall Superconscious.io, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Services.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or the Services exceed the greater of (a) the amount you have paid us in the twelve (12) months prior to the event giving rise to the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

12. Mutual Support

You agree to indemnify, defend, and hold harmless Superconscious.io, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your User-Generated Content; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) your violation of any applicable law, rule, or regulation.

13. Concluding or Pausing Service Engagement

Your Choice to Conclude

You may terminate your account and stop using the Services at any time by following the instructions within the Services or by contacting us. Upon termination, your right to use the Services will cease immediately.

Our Need to Conclude or Pause

We may suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including but not limited to a breach of these Terms, with or without notice. We will endeavor to provide notice when possible and appropriate.

Upon Conclusion

Upon termination of your account, certain provisions of these Terms will survive, including but not limited to: intellectual property provisions, warranty disclaimers, limitation of liability, indemnification, and the governing law and dispute resolution sections. We may, but are not obligated to, delete your User-Generated Content and other data after termination, in accordance with our Privacy Policy and data retention practices.

14. Framework for Understanding and Resolution

Guiding Principles

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Texas for the resolution of any disputes.

Pathways for Resolution

We encourage you to reach out to us first if you have any concerns or disputes. Most issues can be resolved through open communication. If a formal resolution is needed, you and Superconscious.io agree to first attempt to resolve any dispute informally. If informal resolution is not successful within thirty (30) days, either party may pursue binding arbitration administered by a recognized arbitration body, under its rules then in effect. The arbitration shall be conducted in English and take place in Texas.

Individual Focus (Class Action Waiver)

You and Superconscious.io agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Superconscious.io each waive any right to a jury trial.

15. Evolving with Our Community

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make changes, we will update the “Last Updated” date at the top of these Terms. For material changes, we will provide you with prominent notice, such as by posting a notification within the Services or sending you an email.

Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, we respect your choice to discontinue using the Services.

16. General Understandings

Complete Understanding

These Terms, together with our Privacy Policy and Disclaimers page, constitute the entire agreement between you and Superconscious.io regarding your use of the Services, and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Superconscious.io.

Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.

Communications

By creating an account, you agree to receive electronic communications from us (e.g., via email or through the Services). These communications may include notices about your account, transactional information, and information concerning or related to the Services. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

17. Text Messages / SMS (OTP Authentication)

We may use SMS text messages solely for the purpose of sending one-time passcodes (OTPs) to authenticate your identity and secure your account. By providing your phone number for authentication, you consent to receive these messages.

  • User-Initiated Messages: SMS messages are sent only when you initiate an authentication request (e.g., logging in, verifying your account).
  • Message Frequency: One message per authentication request. Additional messages are sent only if you initiate another request.
  • Carrier Charges: Message and data rates may apply depending on your mobile carrier plan.
  • Opt-Out: You can opt out of SMS messages at any time by replying STOP to any message. After opting out, you may need to use an alternative authentication method.
  • Help/Support: For help, reply HELP to any message or contact us at hello@superconscious.io.
  • Carriers Not Liable: Mobile carriers are not liable for delayed or undelivered messages.
